These Terms are an agreement between Pacific Unified Systems LLC (“VoiceSuites,” “we,” “us”) and the business that signs up for VoiceSuites (“you”). They cover our website, the portal, our apps, Call Links and website widgets (the “Service”). By creating an account or using the Service, you agree to these Terms and to ourPrivacy Policy. If you sign up for a business, you confirm you are allowed to accept these Terms for it.
The Service
VoiceSuites is a business phone system: phone numbers, menus, teams, routing, voicemail, recordings, text messaging, chat and the apps to answer them. We may improve, change or add features over time. If we remove something important you pay for, we will tell you in advance.
Your account and users
- The Service is for businesses and people at least 18 years old, in the United States.
- Give accurate information, including your business details, and keep it up to date.
- You decide who gets access. You are responsible for what happens under your account, so keep sign-in details private and tell us right away about any unauthorized use.
- Information in your account, including customer records, call history, recordings and messages, belongs to your business. When you remove a user, they lose access and the information stays with you.
Fees and payment
- Building and testing are free. Prices for numbers, calls and add-ons are listed on ourpricing page and in the portal.
- Monthly fees for numbers and add-ons are charged in advance. Each number’s fee is added to your monthly calling allowance, which resets every month.
- Calls beyond the allowance are paid from your prepaid balance. Your balance does not expire. If you turn on automatic top-up, we charge your saved card when the balance falls below the amount you choose.
- If your balance runs out, some calls may pause until you top up. If fees go unpaid, we may suspend the Service after giving notice.
- Prices do not include taxes and regulatory fees, which we add where required. We will give you at least 30 days’ notice before raising a price you already pay.
- Except where the law requires otherwise, payments and balances are not refundable.
Phone numbers
You can bring numbers you already own and move them between teams and lines. While your account is in good standing, you may move (port) your numbers to another provider. Numbers that are cancelled, or left unpaid after an account closes, may be released back to the carrier.
Acceptable use
You are responsible for how your business and your users use the Service. You may not use it to:
- Break any law, including telemarketing, robocall, caller ID, privacy and consumer protection laws such as the TCPA and the Telemarketing Sales Rule.
- Make automated or prerecorded calls, or send texts, to people who have not given the consent the law requires.
- Send spam, phishing or misleading messages, or hide or fake your identity or caller ID.
- Harass, threaten or defraud anyone, or send content that is illegal, hateful or sexually explicit.
- Run high-volume dialing or messaging campaigns, or resell the Service, without our written approval.
- Interfere with the Service, other customers or the phone network, or try to get around its limits or security.
Recording calls. Some states require everyone on a call to agree before it is recorded. If you turn on call recording, you are responsible for giving the notice and getting the consent the law requires.
We may suspend numbers or features, or close an account, if we reasonably believe these rules are being broken, or if a carrier or regulator requires it. Where we can, we will tell you first and give you a chance to fix the problem.
Text messaging
Text messaging through VoiceSuites is carried by mobile carriers, who require businesses to register before they send messages (10DLC registration). Until your registration is approved, you can read texts sent to your numbers, but replies may not be delivered.
- Only text people who have agreed to receive messages from your business, and only about what they agreed to.
- Tell people who you are, how often you may text, that message and data rates may apply, and that they can reply STOP to opt out and HELP for help.
- Honor every opt-out right away, and keep records of consent.
- Do not text about content carriers prohibit, such as illegal drugs, firearms sales, gambling or debt relief.
If you receive texts from VoiceSuites (for example, account alerts), message frequency varies and message and data rates may apply. Reply STOP to stop and HELP for help, or email [email protected]. Carriers are not liable for delayed or undelivered messages. We do not share mobile numbers or opt-in information with third parties for their marketing, as described in our Privacy Policy.
Emergency calls (911)
Calling 911 over the internet works differently from a landline. Please read this section and share it with everyone who uses VoiceSuites.
- Emergency services receive the address registered for the office or the person calling. You must register an accurate address for each location and remote user, and update it whenever someone moves. If the address is wrong, help may go to the wrong place.
- 911 calls from the desktop app, browser or desk phones need power, a working internet connection and the app running. They will not work during a power or internet outage.
- 911 calls from the mobile app are placed over the phone’s own cellular network.
- When someone calls 911, account owners, admins and reception are notified by email.
- Keep another way to call 911, such as a mobile phone or landline. To the extent the law allows, VoiceSuites and its carriers are not liable for problems reaching emergency services.
Healthcare and sensitive information
VoiceSuites is not HIPAA-compliant yet, and we do not sign business associate agreements. Healthcare businesses may use VoiceSuites for general business calls, but you agree not to use it to record, store or send protected health information. Also do not use it to store payment card numbers or other highly sensitive data.
AI features
Some features use AI, such as suggesting your setup and understanding what callers say to a Smart Menu. AI can make mistakes, so review your system before you go live and test it with our free test numbers.
Our rights and yours
We own the Service, including the software, apps and design. You may use it for your business while these Terms apply. You keep all rights to your information and content, and you let us process it only to provide and improve the Service, as described in our Privacy Policy. If you send us feedback, we may use it without owing you anything.
Ending the Service
You can cancel numbers and add-ons, or close your account, at any time in the portal. Cancelled items stay active until the end of the period you paid for. We may suspend or end the Service under the rules above, or if we stop offering it, with reasonable notice. After an account closes, we delete its information as described in our Privacy Policy, so export anything you want to keep first.
Disclaimers
We work hard to keep VoiceSuites reliable, but phone and internet networks are run by many parties and can fail. The Service is provided “as is” and “as available,” without warranties of any kind, including merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows. We do not promise that the Service will be uninterrupted or error-free, or that every call or message will be delivered.
Limitation of liability
To the extent the law allows, VoiceSuites will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business, even if we were told they were possible. Our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim.
Your responsibility for claims
You agree to defend and cover VoiceSuites against claims, fines and costs that come from your content, your calls and messages, or your breaking these Terms or the law, including telemarketing, messaging and recording laws.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts in Sacramento County, California.
Other terms
- We may update these Terms. We will post changes here and tell you about important ones by email or in the portal at least 30 days before they take effect. Continuing to use the Service after that means you accept them.
- If part of these Terms cannot be enforced, the rest still applies.
- These Terms and the Privacy Policy are the whole agreement between us about the Service.
- We are not responsible for delays caused by events outside our reasonable control, such as carrier or network outages, natural disasters or government action.
